Arizona Gov. Doug Ducey signed SB1090 on April 1. The bill had been supported by Arizona Builders Alliance and other construction trade associations.
SB 1090 modifies the ban on project labor agreements in public works construction. It adds further language that prohibits public agencies from requiring a “neutrality agreement” from a contractor as a condition to a contract. Neutrality agreements prohibit a contractor from resisting a union organizing effort at any location, including projects for other entities.
SB 1090 also prohibits the use of government approved apprenticeship programs as a condition of doing work for an agency.
The bill passed the House and Senate and mostly party lines; Republicans in support and Democrats in opposition.
